The marriage took place in New York, and either party has lived there for a year or more prior to filing
The marriage took place out of state, but the couple lived together in New York and either party has been living there for a year or more prior to filing
The grounds for divorce (see below) took place in the state, and either party has lived there for a year or more prior to filing
The grounds for divorce took place in-state, and both parties were residents at the time.
Either party has lived in New York for two years of more

Irretrievable breakdown of the marriage for six months or longer. Under these grounds for divorce, no party is at fault.

Imprisonment of three years or more
